Apple Earpods with iPhone 4 issue - iphone mic not muting?

Hey,

I recently purchased the Apple Earpods from a store online in Israel,
the first pair i have recieved were defective, and i have been sent a working pair.

I'm having an issue with these earpods -
while using the mic during a call, the actual iphone's mic (bottom of iphone 4) isn't muted thus having the mic's noise from the bottom disturbing the call (wind, pocket noises).

Is there a way to setup the earpods through the iphone 4 ?
Can i mute the mic while using the earpods?

ARE THE EARPODS DEFECTIVE ?

Excuse me if this is just a completely unhelpful response, but...are they plugged in all the way? I have the same issue before my earpods are completely plugged in.
