Apple Store device only

I just went to the apple store and picked up my iphone 5 , I asked to buy it a non commitment price, which the genius agreed on, however, it didnt work so I then decided to just upgrade my line and take a discounted iPhone 5, but that didn't work anymore because the system wouldn't work.

he then told me will sell me the iPhone as a device only, does it mean its factory unlocked?

which apple store has in stock?

If its an AT&T device only i5 then its fully unlocked.
If its a verizon its also unlocked no matter how you bought it.
If its Sprint its NOT unlocked even if you paid full price.

It is an AT&T store, is there any way I can check if its unlocked without a different sim card?

I placed an order at 10PM yesterday and was lucky to get a white 32GB in Santa Monica,ca
