Apple SUPER BOWL ad rumor..."1984"

I'm watching Letterman right now... and CBS had a superbowl add on tv, among images of rock stars they flashed the scene from the infamous "1984" macintosh ad, where the girl swings the hammer into the giant screen... hmmm wouldn't that be copyright infringement?! unless apple ok'd it or perhaps it will be part of a "retrospective" type Mac ad.

I'm sure CBS would have cleared copyright with Apple since the ad reinforces the Apple brand.
