The recent Apple lawyer note said:
"yet-to-be released product" - I'd say that infers that it exists, but isn't yet released. Otherwise, it's a yet-to-be released non-product.
"the product's appearance" - Again, it implies there is a product, unreleased.
If there was no product, it wouldn't have an appearance.
If there wasn't information on appearance, features, physical samples, how could someone have access to such information? ("Anyone who might have access to such information would be bound under the strictest
")
They're not denying it. How could it be a trade secret, if there is no product?
