my remote randomly has issues, it seems the trackpad stops working, appears the buttons work. I have to shut down or hold remote right up to unit and press main button and volume up and then it starts working.. is this a defective remote or something in the settings?

That’s certainly not expected behavior and I don’t believe a setting would be causing that. I would personally start by erasing the Apple TV to see if it still happens. If you have another Apple TV in the home, see if you experience the same thing with the remote from that one. I would also see if you have navigation issues while using the Remote app in iOS. Especially if it still continues after erasing and if another remote or the Remote app work fine, I would contact apple support and see if they’re able to mail you a replacement.

The remote does use bluetooth, so can be affected by RF interference

it works better "line of sight" so if the aTV is hidden behind the TV, or in a metal cabinet, try moving it
you can probably still get away with behind the TV, it might just have to move a bit.

2.4 wifi is very close in frequency to bluetooth, so if the aTV is right beside your router, you might have issues,
same goes for being by your TV or any other electronics, perhaps it's up against the other devices wifi antenna.

mine is behind the TV, and I occasionally have this problem.
although for me, the touchpad still works, it's just very hard to control and sluggish.
normally I just have to hold menu+volUP, I don't have to get close to the TV, it works from my couch about 10 feet away.
when I first wall mounted the TV, I tucked the aTV inside the metal bracket holding the TV, and I was having this problem frequently, once I moved it, it's been much better.

I have found that tapping at the center of the four edges will work like the old navigation buttons. and can be a little easier to control than swiping
