Apple TV choppy and apps not saving

Anyone having their new Apple TV playing video back that looks all jerky and robotic? Any idea how to fix it? Also HBO GO never saves my spot when I come back to it I have to manually go find the last episode I was watching. Pretty annoying,

Either it's something to do with your network/internet connectivity or you need to exchange it -- mine's streaming silky smooth.

Restore it and see if it improves.
