Apple was not able to get an AirPods Pro class action lawsuit filed in November 2024 dismissed, but the judge overseeing the case did throw out some of the claims this week, giving the company a partial win.

The lawsuit covers the first-generation AirPods Pro, accusing Apple of false advertising for selling AirPods Pro models with ongoing crackling or static issues. Shortly after the AirPods Pro went on sale, customers began complaining of crackling, rattling, popping, and static-like noises. Apple issued a software update in May 2020 to attempt to fix the problem, and then later launched a repair program in October 2020.

The customers who filed the lawsuit requested relief due to the defective nature of the AirPods Pro, and they said they would not have purchased the earbuds or would have paid less if Apple was forthcoming about the flaw.

Apple filed a motion to dismiss the lawsuit in March 2025, leading to the mixed result handed down this week. Claims related to some state fraud and consumer law were dismissed, as were those related to express warranty and implied warranty. Nationwide claims were also thrown out because the plaintiffs failed to present a representative plaintiff from each state, which the court said is required for nationwide counts. Some plaintiff-specific claims were dropped, and a claim for unjust enrichment in California did not survive. The court also denied injunctive relief because the original AirPods Pro are no longer offered for sale.

The fraud by omission claims survived, and Apple is accused of failing to disclose known AirPods Pro defects even after acknowledging them publicly with the 2020 service program. Several of the state, nationwide, and warranty claims can be amended and refiled with more information in the next 21 days, so some of the claims could be revived as the case goes on.

Plaintiffs will need to prove that Apple was aware of the defect and concealed it following the 2020 repair program, and that the company denied valid warranty repairs for those claims to move forward.

The surviving fraud by omission claim could prove to be an obstacle for the plaintiffs later in the decision process, and it could ultimately be dismissed. Citing prior case law, Apple argued that it only has to disclose safety issues after the warranty period has expired, and the AirPods Pro sound defect was not a safety hazard. The court did not reject Apple's argument, and simply said that it was premature for it to consider the issue at this stage.

I had this issue with my launch AirPods Pro, and had mine replaced. Then it started happening again a little while before the second gen came out. Just ended up buying the second gen which were rock solid.

Now I have the third gen. Anyone have problems with the case lid feeling kinda loose on your third gen? I would sometimes fidget with mine a little and my second gen feels rock solid still, while I noticed my third gen was already slightly creaky with some side to side play, even when closed, and I can’t replicate that with my second gen. Wonder if I got a lemon or if this will become a more widespread issue? The AirPods themselves are great.
 
I've owned 3 AirPods Pro 1st gen (popular Christmas gift). All three started cracking after a year. All three were replaced under the repair program. The repair program ended and all three started cracking again.
Same with my two. Still crazy I have no recourse. I love my pro2s and 3s but consumer protections suck against design flaws
 
Apple replaced mine 'out of warranty' under the service program at no cost. The original AirPods Pro sure suffered this issue.

Sick of litigation being weaponised against storied companies like Apple.
This was a legitimate issue, and Apple refused to do the right thing. My own pair of AirPods Pro started crackling *just* after Apple discontinued the repair program, and about 3 weeks after my AppleCare ran out on them. It clearly is a fixable problem, as it only occurs when NR is on. The fact that Apple denied it was an issue, stalled, and then begrudgingly set impractical restrictions around what should have been covered for replacement/repair has nothing to do with Apple being a "storied company". They have corporate responsibilities under consumer protection law, and at every turn did the least possible, choosing to fight it at great expense through the courts instead. Your blatant attempt at dog whistle indignation for "weaponizing litigation" is the worst kind of political hubris.

I still have mine which are defective with the same issue! Is it even possible to get them fixed or replaced now?

I'll be honest, this was a major reason I never bought the AirPods Pro 2 because I didn't want to have the same problem...

That doesn’t sound right for your 3rd gen. I would suggest calling Apple to see if they will replace the case. BTW, I’d stop fiddling with your case, that could be why it’s doing what it’s doing… 🙏🏼
 
I bought more than one pair of gen 1s, and sent them a couple of times to Apple to have them “repaired.” The renewed pairs would always start crackling, and Apple eventually refused to repair them.

I’ve used my AirPod Pros 2 the exact same way for years now. Clearly gen 1 was defective.
 
I had my 1st gen Pros replaced twice by AppleCare+, used to drive me crazy! My second gen Pros have been fine a year in though
I similarly replaced two sets of Pros. It was slightly annoying but ultimately it probably extended the life of them significantly and saved me from needing to upgrade at least one cycle. I count it as a win.
 
The judge should throw everyhting out. These people with issues were obviously listening to them wrong.
 
I had this issue happen to my AirPods Pro but it was several years later when the issue started. It didn’t happen right of way though. Funny things is I thought it was just wear and tear from me wearing them a lot while working out and it must have been my sweat that was causing this problem.

I had no idea this was a widespread problem. So I guess it wasn’t how I was wearing them after all.
 
When this was happening, I brought two pairs of 1st gen Airpods Pros to an Apple store that had the crackling and static and Apple tested both pairs. They were both positive for the issue, but Apple didn't replace either pair. They said one pair wasn't in the serial number range of the recall and the other pair "weren't brought in soon enough" after purchase. They offered to see the individual earbuds to me at $89 each. I said, "I can go on Amazon and buy a completely new pair for $169," and they couldn't match the price, so I walked out pretty annoyed.

I really like Apple products, but I thought it was absolutely ridiculous to have acknowledged the issue with a recall, test my devices that have the issue, then not replace/repair them for some technicality like that.
 
I have this model of AirPod and they have this defect but Apple despite being aware that it is a manufacturing defect did not want to repair them because the warranty has expired.
