As you can see in the attached screen shot I'm going to be waiting a long time for iOS 8.... plus an Apple TV we have is doing an update with 5 hours remaining on it. :( and no , its not our internet connection, we are on a private leased line 1:1 contention ratio and its not even at 50% utilisation at the moment.

They could have a minor problem, but they aren't 'battered'.

They have incredible bandwidth, their restore and app store ran flawless through the 10million iphones sold weekend. If that didn't bring it to the knees. A random early morning isn't.
 
i tried to download 8.0 last night around 8pm and it took over an hour. had to redo it later, and around 12pm it only took 10 minutes. my guess is that, yes, they're being battered during peak times.
