are kernel panics hardware related?

im inside the return window and wondering if I should be worried about my kernel panics.
This is a custom, 2.3 16".

Usually my crash occurs when connected to external monitor in clamshell and then waking up from sleep (i havent really tested without the monitor as Ive been stuck at my desk and its a new system)

I had issues with my last MBP so i made a fresh install this time but seems thew problem persists.

I would like to return in the 14 day if its ongoing hardware issue.

Especially if it happens with fresh system I would exchange it immediately.
