Are we able to upgrade to 4s and keep grandfathered unlimited data with AT&T?

There are rarely plan changes w/ new devices.

What if you have the AT&T unlimited plan but are not eligible to upgrade yet your family member is.

If I use his upgrade for myself, will that affect my data plan?
