I am on a 2 year contract with AT&T signed last October with 4S. If I get iPhone 5 and sign new 2 year contract, will AT&T unlock my (old) 4S which will be out of contract.

Any one dealt with AT&T in this regard.

No. The 4S can be unlocked October 2013. 2 years for original purchase. Unless u pay the etf.

U may get lucky with rep online. But2 years from activation by original owners att official unlock policy unless u pay etf or are in military getting transferred abroad

They unlocked my friend's 4S while he was still in contract. I guess he got lucky with the online chat rep. Cannot hurt to try especially since your 4S will be done with the contract. They even have an online form to put in the unlock request now, saves you a bit of trouble trying to get the right rep.

If they dont, ebay sellers are doing IMEI unlocks for as little as 13$
