My sister is switching from AT&T over to Sprint due to the unlimited talk/text/data plans. She wants me to sell the AT&T phone on CL, does she need to wait till after she takes care of all the ETF's and Fees or can she just sell it now and use the money to cover the fees? It's not a next program and was bought at the subsidized price (299?).

The two issues are separate. She owns the phone. Leaving AT&T early results on an ETF charge.

She will have to pay the ETF that, in part, will cover AT&T's exposure in the subsidy price. You/she can sell it now and use the money to cover the ETF.
 
She can sell it anytime, but it will be locked to AT&T and not worth as much as an unlocked phone. After any remaining balance and the ETF is paid, she can ask AT&T to unlock it and it will be more valuable.
