So I bought an iphone 5 at retail price, and was using it with my iphone 4 micro sim. However, I wasnt able to get LTE with the iphone 4 sim!

Then I called AT&T to tell them I would like my current micro sim number transfer to the nano sim that I got with my iphone 5 which has not be actiated!

Everything went smooth no problem! inserted the nano sim I got LTE right away.
Now I received my bill and saw the $36.xx activation fee then I called them to see what would they charged me that for since I never upgrade or anything.

The rep tells me that since I'm using an iphone 5 they have to charge me an activation fees because it is an upgrade for them   i told her that was none sense I could have used my iphone 4 sim with my iphone 5 and they wouldnt know unless I let them know! Anyways, long story short the rep did not make any sense at all refunded/waived the activation fee and this one time only she tells me

Anybody got this type of really greedy AT&T situation where they would charge you activation fees just because you switch phones!?
