They should be unlocked. If not just make a phone call to ATT

If you pay full price they should be unlocked, if not then just call up AT&T and they will unlock it for you if you paid full price.

As far as I'm aware, if you get a phone from AT&T, at full price, the phone needs to be active with us for 3 months before it can be unlocked.
If you're doing the upgrade program from Apple it sounds like those are immediately unlocked.
