ATT Upgrade Swap Q

- I have an iPhone 5 on a family plan with my brother.
- My brother is eligible for an upgrade but has no interest in using it.
- He's agreed to let me upgrade swap to a 5s but he doesn't want my iPhone 5.

The question is: if I do an upgrade swap and replace my iPhone 5 with a 5s, and he keeps his current phone... am I free to sell my iPhone 5 to a third party?

You might want to check the trade in value at BestBuy and get your new phone there. I did that with mine and it worked out great. It was an upgrade swap too.
