iPod touch best brains?

My itouch intermittently pauses and atimes refuses to charge or be noticed by itunes.I restored it once and it still behave as such.Advice me

Is it new? If so, bring it to Apple for repair or exchange, sounds like a hardware issue with data/power connection.
