Best way to buy a new 3.1.2 or lower Ipod Touch?

Is there any good way or place to buy from so that I can buy a new 3.1.2 or lower itouch to JB? I just bought a new one and it already has the 3.1.3 firmware. I could buy used, but I really want a pristine one.

Is there a way to tell from the external packaging what the firmware is???

Ebay might be your best bet. There are sellers that should have some left, since they buy in bulks.

Yes Ebay/Craigslist is your best bet

I got mine in Oct 09 right after they droped the 16gb and started charging 300 for the 32gb-I got one on ebay(BRAND NEW-FACTORY SEALED) for 200 even

On Craigslist-I got a 16gb Touch for 100bucks-just one scratch on the screen-and sold it for 200

seems like there is a pretty good supply on ebay. It seems like all the 2nd gen (even if they are "New") are MB although I have read that some 2nd gen can be MC?

If it's an MB with 3.1.2 or earlier, is this guaranteed to be jail breakable?

Yeah. All the firmware besides 3.1.3 is jailbreakable. The 2nd generation MC verison might be tethered like the 3rd gen. But it's still jailbreakable.
