I picked up an Series 5 on sale but I'm not able to update it and therefor cannot pair it with my iPhone.

The watch needs to be updated but when trying to update I'm constantly getting an error saying "Unable to check for update... you are not connected to internet".

I've tried with 3 different iPhones (7/7+/12) and the same error is displayed on all of them. I've tried resetting the watch and rebooting the phones but nothing resolves the problem.

Any suggestions what to do? Does Apple still have the server breakdown from yesterday?

what iOS version are you running? AW5 new should have watchOS 6, your 12 will be 14.x, not sure you can pair a brand-new watchOS 6 with iOS 14.
I would contact apple ...

I guess Apple had some server issues yesterday. Today updating was successful and the watch is paired.
