brightness setting issue

I noticed that the phone brightness setting does not seem to work when the phone is going from sync mode with itune to the home screen. for example: click on sync from itune. once sync is done, it took me back to the home screen at full brightness level.

in order to have brightness setting working, I have to put the phone in lock mode and then unlock it.

anyone experience this issue?
