I'm not eligible for upgrade, but the iphone 4 hasn't been working right for a month. Few problems caused by a drop. Can I call apple and pay 199 for iphone 4 replacement? or 4s? even though im getting full retail pricing online?

This stuff about not being able to get the 4S for 199 if you sign a new 2 year contract is silly. I was always able to get a new phone as long as I signed a new two year. Why all of a sudden is apple so up tight with the 4S?

You should be able to trade in your broken iPhone 4 at an Apple store for a refurbished model for the standard $199 unless they've lowered that fee.

Probably because they want to get their full subsidy for the old phone?

Also this would be the carriers decision, not apples.
