If I buy a iPhone 5 at a US Apple Retail Store with full-price of AT&T GSM, it will be without contract and unlocked( I can use it with a chip from another carrier) ?

That 10PM reservation is for new line or upgrade of an existing line. So in practice usually AT&T/GSM iPhone are usually sold out unless a store has a large shipment.
If you go in the morning and they have spare stock to sell, just say you want to buy as device only.

This is what I'm trying to do, but I live in NYC and it's impossible to find them in stock yet :/.
If you're okay with contract, just buy the phone and then get it mocked through vendors on eBay. I ended up going the unlock_fusion route and my iPhone 5 is now Apple-unlocked.
The 5 apple stores here in NYC wont let anyone buy it w.o a contract anymore :-( i tired so many times
Bought an AT&T iPhone 5 16GB at an Apple Retail store on Saturday. Restored the iPhone and received the Congratulations Unlocked message on iTunes. Haven't tested it out, but it seems like it will unlock it without AT&T's request.
