If I were to go into AT&T to buy one of the iPhones refurbished and i paid with a card would it be linked to me in any way. I planned to tell them I was buying it as a gift and that the recipient would come in to set up a new plan. Would it be linked to me if I actually intend to sell it. For instance if the person I sold it to called in about it, would they pull up it's serial or IMEI and show that I am the original owner? I just want to cover all bases.

If it did, they can't do anything about it. The phone is nothing until activated. THERE IS NO ACTIVATION IN THE STORE, activation is all done through iTunes. Any at&t person who says otherwise is wrong. If they try to force you to sign a contract (unless you want a cheap/free phone as a backup) walk away and complain to at&t corporate and Apple.
