Buying an old "new" ipod rebate?

On the local craigslist in my city there is someone selling an 8 gb iphone for $400. it's brand new, as in still sealed in the box. if he/she purchased this phone before Aug 22, and i buy the phone, activate it now,

will i get a $100 rebate or will they get it or will no one get it because it was activated after the price drop?

Interesting.
If you activate it thru AT&T you should be able to punch in the serial and your cellphone number and get the $100.

The question of the $100 rebate determines whether or not this is a decent deal. do they keep track of when each phone was actually purchased? probably not unless you have the receipt, which the seller does not.
