If i buy a black iphone 5 at bestbuy and i open it there and there happens to be scuffs would they let me open another one till i find a perfect one? thanks

It doesn't answer your question but all the phones Best Buy receives around me are already allocated to people on a waiting list. I don't know if they have replacements on hand or if they make you go to Apple. Hope for the best and hopefully you won't need to know the answer!
