ok so i want to jailbreak but want to keep my warenty. has anyone taken there previously jailbroken device to apple and they found out it was preveously jailbroken? thanks!

You are fine to jailbreak, just make sure you bring it back to stock before visiting Apple for an issue with your iPhone. They could refuse to service your phone if they see that it's jailbroken.
Two scenarios:
1. The device is unbootable due to hardware failure and they are unable to tell if it's jailbroken because it won't turn on.
2. It's only messed up in the software at which point you can restore, thus unjailbreaking it, and probably fixing your problem.
