No, unless you purchased it in the last 2 weeks and it's sealed. My suggestion? Try selling your current one for as much as possible on eBay, and use that money towards a new one. I'm afraid you won't be upgrading for free.
 
well 2 nights ago, my ipod touch got extremely hot and the apple logo was brown in stead of silver and the background was white instead of black and this really terrified me. i am soo scared to plug it in now. honestly. and this is the third time this has happened after the 2.0 update.
 
I have been holding onto a 1st gen ipod touch with battery problems for a while in hopes that when I send it in for repair, I'll get a 2nd gen. This this won't happen? What will I get in return? It is under warranty.
 
My store doesn't have the new Touch (Richmond VA), I tried to return mine (old version) this evening but they said no you can't because it was 15 days after purchase and also they don't even have any new ones till this weekend, they are still displaying the OLD Touch in the store with no signage or anything to reflect that there is even a new one in existence. So an unsuspecting person can go buy them at the $299 price for 8. That's "not nice" according to my daughter..I was thinking something a bit more than just that..
