My old 3g is still under warranty until the end of July, but I bought a 3gs and activated it. Will I have problems at apple if I try to replace my 3g due to cracks all over the case, since it is not activated anymore, even though I own it and it is still technically under warranty?

It's not technically under warranty, it is under warranty, being used or not.
 
Can't you just stick the 3G S SIM card in the 3G when you go to replace it just to be safe?

Once you put it in, you'll get a signal.
 
I just did this at the Genius Bar yesterday, for the same issue. It was not a problem. I didn't have a SIM card in the 3G phone and they didn't make me swap it in-store to activate the replacement. They just sent me home with it unactivated and the new owner can activate it with their own SIM. I just explained the situation and they were fine with it.
