Can i swap my att iphone contract with an unlocked iphone?

Hi,

I have an iphone with 2yr att contract, but unfortunately its in baseband 04.10 and so cannot be unlocked yet. But my friend has an iphone with baseband 01.59 but that is also in 2 yr att contract. Is it possible to swap our phones so that I can unlock and use my friends 01.59 baseband phone while he will be using my iphone with his contract connection?
I am willing to pay the breakage fee to ATT.... its kind of urgent, any help would be higly appreciated

It's as easy as swapping SIMs. You don't even need to tell AT&T
