Can i use my freinds iphone without the contract

Hi , im new to the fourms

My freind recently got a iphone 3gs because his old contract with the original iphone was over.

I was just wondering if i can use his origanal iphone somewhat simmarly to an ipod touch , i have no need to use the phone service

so i was wondering do i need to have the service with atnt for it to work or can i just leave the way it is and use my apple id acount with it

I think he has the 3.0 software

You can use like an iPod Touch if you like.
