Can not permanently delete jpegs on PB

I've been deleting some desktops I had downloaded and now, whenever I try to empty my trash, I get an error telling me the files are in use. Its happened several times over the past few days and basically, I have to shut down my PB or log out to get them to delete on the next try when I log back in. Any ideas?

Another thing is, I tried running "Verify Disk" in Disk Utility and it couldnt verify my "Macintosh HD" (my hard drive). It told me it needed repair. Am I in sh*t?

Did you try repairing it? It sounds like a file system problem...try using the repair feature in Disk Utility and maybe repair permissions. Also, try making another admin account to see if things still don't work in that account.
