Perhaps you could try taking them on a date first before propositioning them? j/k duke!

Lol

No, I see alot of CL postings for roommates and when I inquire, I get told

"no thanks, we are looking for a female only"

Happens more than once with both guys and girls posting the ads:confused:

Doesn't seem right

No, I don't think landlords can, but if it is just someone subletting a room or looking for a roommate, they can choose, or not choose, whomever they want.

Colorado law ... yes you can deny a roommate on their sex, religion, smoking habits etc. As a landlord you cannot.

I have a hard time believing that a landlord can't deny someone a room because of their smoking habbits. A landlord can declare his house/room/appartment/etc to be smoke free.

On the other hand duke just needs to grow a pair [of breasts]. That will solve all problems.

I believe they can declare the unit smoke free, but they can't outright say no to a tenant because they smoke. Just like a hotel doesn't say a smoker cannot stay there, they make rules that state you cannot smoke in their hotel. I can pull the law in a bit if it's critical to know for a fact. That's up to dubebound.

Depends on the state. I'm pretty sure it's illegal in NY, for instance -- at least to state a preference in the ad. If you show the place to both genders, who's to say you selected the roommate based on gender in the end?

Found this on CL:

What are the laws for roommates and shared housing?

Federal Fair Housing laws for roommates and shared housing have two components: advertising and decision-making.
  • Advertising: Federal Fair Housing laws prohibit discriminatory advertising in all housing, regardless of how large or small the property. However, as discussed below, advertising which expresses a preference based upon sex is allowed in shared living situations where tenants will share a bathroom, kitchen, or other common area.
  • Decision-making: Although the prohibition on discriminatory advertising applies to roommate and shared housing situations, federal Fair Housing laws do not cover the basis of decisions made by landowners who own less than four units, and live in one of the units. This means that in a situation in which a landlord owns less than four rental units, and lives in one of the units, it is legal for the owner to discriminate in the selection process based on the aforementioned categories, but it is illegal for that owner to advertise or otherwise make a statement expressing that discriminatory preference.

Are there any exceptions to the advertising laws?

Under federal Fair Housing law, the prohibition on discriminatory advertisements applies to all situations except the following:

  • Shared Housing Exemption -- If you are advertising a shared housing unit, in which tenants will be sharing a bathroom, kitchen, or other common area, you may express a preference based upon sex only.
  • Private Club and Religious Exemptions -- A religious community or private club whose membership is not restricted based upon race, color, or national origin may restrict tenancy only to its members in a property that it owns, and may advertise to that effect.
  • Housing for Older Persons Exemption -- As discussed below, certain complexes for elderly persons are exempt from prohibitions on familial status discrimination, including the prohibitions on discriminatory advertising.

If she is smokin HOT according to me. My god I'll accept her into my apt in a split second just as I would hump her in a split second if she asked me to. I like to think its likely to happen if they live in the apt. :D

It's strictly a matter of personal bias and not a legal issue concerning the process by which one chooses a room mate. And even if the law says you cannot discriminate in advertising that does not stop the individual seeking the potential room mate from discriminating during the face to face interview process.

And there you have the #1 reason a house with women in it might be less than receptive to an unknown male looking for a room.
