Is it possible to get a 3G at $99.00 with no contract from Best Buy?

I did that with my 3GS, i took it home to activate with AT&T, otherwise it was sealed they didn't activate it, or ask any other questions..

No. The $99 price is subsidized by AT&T, and AT&T wouldn't like that if you didn't commit to a contract :].
