Can you still buy iPhoto 9.6.1 on CD

I am running iPhoto 09 (8.1.2) and just moved to Sierra. Everything I am reading says you need at least iPhoto 9.6.1 to have your iPhoto library migrate into Photos. I don't have access to it through the App store (never bought it) but was wondering if back in the day they sold iPhoto 9.6.1 on CD.

Unless someone knows different if I can't upgrade from 8.1.2 I will have to move over everything into Photos and loos alot of metadata.

You don't need version 9 of iPhoto in order to upgrade your library to work with Photos. In fact, any library created with iPhoto '09 (v8.x) or later can be upgraded by Photos. Did you run into any issues trying to do so? Have you read the support article at https://support.apple.com/en-us/HT204655 ?
