If I am on AT&T Next, can you upgrade after 12 months on Apple.com or do you have to go through AT&T? How does AT&T receive your old phone if you order through Apple?

Yes you can, AT&T gets notified of your purchase through Apple.com then sends you a shipping label or box to return your phone.
Yes you can. Just make sure you are paid up on your phone lease. I just realized I wasn't eligible for an upgrade until I made one more payment.
