In light of the battery problems, lack of obvious solutions and an uncertain time -table for these fixes, I am considering canceling my order for the 4s and maybe waiting at least a month or until I hear these problems are gone. If the battery problem is hardware related, will Apple replace the defective phones?

I doubt it. The magnitude of the recall would be ridiculous.

If it were, Apple would do what needs done. But it's not a hardware problem, that's clear from the number of people who have either solved or caused the problem by making settings changes. It's a software issue and will be dealt with in a software update.
