Ok just the other day my IP5 power button stopped working, took to apple store they swapped it out with New IP5 OS6.1 installed.

Now I went to Icloud and it shows my old IP5 and my New one which states (this phone) so I go to delete my old phone Icloud backup and it says

"iphone icloud backup cannot be deleted because it is in use"

So what do I need to do to delete this deleted? tried the reboot and such. Is it something on Apples side that they have to do to my old IP5?

You probably backed up from that old one, so it thinks it is in use. I think you would need to back the phone up again, and then restore from the one you just created....then you may be able to delete the old one.
 
Maybe but it has the too Iphones showing backed up one has (this phone) under it and I know its backing up to that phone cause I did a backup and it put this mornings time on it. The other phone still shows backup up Feb 3!
