Actually, these files were on my mobile phone, and I tried to delete these on my Mac. Now, these files sit in my Trash whenever I connect my phone to the Mac.
Ah! That could explain it - different OS and the Mac does not recognise them.
Where were they on your 'phone?

Question:
When you DISCONNECT the phone from the Mac, and then restart the Mac, are the files still in the trash?
If they are not, then there is no problem with "files you can't delete" on your Mac.
The _Mac's_ trash is empty.
You have to figure out how to delete the files on your PHONE.
plug phone in then empty your trash... had the same thing with a usb drive.
