I am attempting to set up an Iphone for my daughter. I restored the phone and while going through the steps for setting it up, I cant tap the "Agree" to accept the terms and conditions, due to that part of the screen not working.

Does anyone have and ideas??

Does autorotate work?
If so, you could just rotate it sideways so the "Agree" button appears in a different corner of the screen.
 
set it up in itunes... anyways, how is the phone going to work if you cant use the keyboard... wow. just wow.

Rotate the device as necessary. OP mentioned only the bottom right part where the Agree button is in the pic does not respond to touch. Sent from my iPad.

Give AppleCare a call or take it to a Genius. I'm not familiar with what alternatives are available during set-up.

Off topic: I haven't seen this many rude answers in a short thread. Have a little empathy and stay on topic. Be nice to the new folks. That dysfunctional corner may not affect how she wants to use the phone. Thread reported.
 
Enable zoom in the accessibility prefs. Then you can make the button as large as necessary and adjust the placement too.
