I was a little confused when I saw this at first too.

Customers must request their Up-to-Date upgrade within 30 days of purchasing their Mac computer.

Initially I thought it was telling me that within 30 days of buying my computer, I had to claim it. That is true only if you buy a computer that doesn't come with it pre-loaded after Mountain Lion is released.

Customers who purchase a qualifying Mac between 11 June 2012 and the date when Mountain Lion is available in the Mac App Store will have 30 days from the OS X Mountain Lion release date to make a request.

For anyone buying a computer between June 11 and when Mountain Lion releases, you will have 30 days from the day Moutain Lion is released to claim it.

They probably should have changed the order of those statements, since right now the first statement doesn't apply to anyone, and people who read that without continuing become confused.

OS X Mountain Lion Up-to-Date Program

The OS X Mountain Lion Up-to-Date upgrade will be available at no additional charge from the Mac App Store to all customers who purchase a qualifying new Mac system from Apple or an Apple Authorized Reseller on or after June 11, 2012.

Customers who purchase a qualifying Mac between June 11, 2012 and the date when Mountain Lion is available in the Mac App Store will have 30 days from the date Mountain Lion becomes available to make their Up-To-Date request.

I bought a new MBP which will qualify, but am I correct that my refurb MBA I got a week ago will not qualify?

The refurbished models don't qualify for the free update, but I think that when you download Mountain Lion from the App Store, it should give you access on all your Macs.

this. Since you did by a new mac, technically the old one does qualify since it is tied to your apple id

Yes. That's what Apple told me when I asked whether the ML upgrade for my 2012 MBA applies to my 2008 iMac, too.
