Hypothetically of course. :D Has it already happened? I'm getting sued for a car accident with no injuries, so I think an STD would be a million times worse. I don't know why but I thought of it while I was just mowing my lawn.

You can sue anyone for anything. All it takes is money, and a greedy lawyer.

Are you asking, can you win damages in excess of the legal fees from such a suit? You'd better ask your lawyer...
 
Only if the other person rapes you. Having sex with someone involves you taking a risk of getting an STD. Some people aren't aware if they have an STD (some only show up in one sex).
 
My wife, who's in law school, says that "if someone knows they have an STD and knowingly infects someone else without telling them" then they can have criminal charges brought against them in SOME STATES for "knowingly infecting others."

Of course, this is a state law, so some states might have it on the books and some might not, although she feels like most states probably have something like this.

I would have thought it would have been illegal to spread infection on purpose, but if you didnt konw you had an STD it would be an exception. Maybe its like the difference between murder and man-slaughter.

BTW im from the UK, so our laws are different here.

Driving involves you taking a risk of getting into an accident, yet people sue after having one
 
If the person knew they had an STD, you could probably compare it to poisoning someone, especially if it's a terminal STD like AIDS.
