Do I need to jailbreak my phone? HD crashed and limited backup of songs/apps.

I have a 32 GB 3GS, and my HD crashed a few weeks ago. I don't really have a backup of my itunes library, although I did get copies of a lot of my songs from an older ipod that I occasionally synched with.

If I update to iOS4, will I not get my songs/apps restored after the update? Should I jailbreak, copy the songs/apps off, import into itunes, restore the iphone, and then update to iOS4?

Any help greatly appreciated.
