Do I need to upgrade to 4.0 in order to backup?

I'll be getting Iphone 4 tomorrow. If I want to sync my information (contacts, photos, music) to the new phone and restore it from my backup, do I need to upgrade to the new software now?

No. A backup has nothing to do with the OS.

Ok, then I probably won't upgrade and just restore from backup tomorrow, thank you.

No. When you back-up your current phone it only saves the data information and settings (not OS).
