iPod touch Do the apps have FairPlay?

It seems like a relly good deal to get the ipod right now on amazon. But if the apps have the 5 machine limit and i restore my ipod, will those restores mark it as a diferent one?

Will all future updates come in separate formats?
for people with the apps and for those who didnt?
