If you buy a NEW SEALED 3GS off of eBay will Apple have any problems warranteeing it? Or does it have to be purchased from retail to be under warranty?

Anyone have actual experience with Apple getting an eBay purchased iPhone swapped under warranty?

I know we can all SPECULATE on what might happen but I'm looking for someone who had actually done it.

Actually it depends where this iPhone comes from. If it's from another country, you get no warranty in US. You have to send it back to the country of purchase for repair.

Of course. it's factory sealed and unused, it has it's 1 year warranty.
Based on the Apple part number you can determine where the warranty will be honored.

The iPhone is only warrantied in the country where the part number is intended to be sold. So if you purchase a USA part number phone on eBay then your warranty is only valid with Apple in the USA. If you purchase an Italian iPhone on eBay, then the warranty is only valid in Italy.
