Does tethering via benm work on 3.1.3 yet?

Can anyone confirm if tethering works on the iphone 3gs yet for 3.1.3 via benm carrier thing? I HAVE NOT jailbroken my phone, and dont wish to. I have ATT. I have the phone currently on 3.0.1 with the benm tethering working, but I wish to update so I can get mms, so can anyone confirm if this is legit working again?

There is a problem with the profile format. When you try to download the carrier configuration file, you get an error message: Profile format is not recognized. It is my understanding that benson is working on resolving this issue.

You can get MMS on 3.0.1.

I would like to know how do you jailbreak 3.1.3 when there is no official JB yet.

There is if you're using a 2G or 3G iphone.
Or if you're on 3.1.2 or previous firmware with a 3GS and update to 3.1.3 using pwnagetool.
