The current policy is to allow unlocking of phones once they're no longer in the 2 year lock period.

So if I upgrade early, and pay the $250 penalty, does that mean my old phone is eligible to be unlocked early?

Yup, it sure does because your old phone is out of contract then.
 
you don't even need to wait the full 2 years. I still have 6 months left on my 2 year contract with AT&T and I was able to get my iPhone unlocked 2 weeks ago.
 
Cool, because after getting a 5 I'd rather travel with my 4S than my 3GS.

Yeah, but I don't want to wait until May for the normal upgrade. :mad:
 
I was wondering this too. I bought the iPhone 4 on launch day with my upgrade... and I got the iPhone 4S on launch day with my girlfriends upgrade. So I am out of contract at the moment.

I probably will give my girlfriend the 4S and unlock the 4. So I guess it does not matter, but it doesnt hurt to know all my options.
