Downloading apps after contract is up

Hi, I bought an iPhone 3G about 2 years ago (2 years July of 2010) I was eligible for AT&T upgrade. So because of the costly mandatory data plan on the iPhone I upgraded to a new phone and removed the data plan. I was wondering. Can I download apps and things from my wireless internet connection. No SIM card and no contract. Basically, use it as an iPod Touch.
