I know if you buy from the educational store you get a three year warranty with no telephone support ala applecare. If you buy one second hand do you still get the three year warranty transferred over to you??

AppleCare follows the product, not the buyer, so I think yes, though you the previous owner should contact Apple so they can change the registration information to you instead of previous owner (it may cause issues if repair needed if it's not in your name), Call to Apple and ask
 
In the US, you only get a single year coverage, unless you purchase the applecare extended warranty. This applies to both consumer, educational, and developer purchases.

Different countries have different consumer protection laws, so I can only state what I know here in the good ol' U.S of A.
