This looks almost like a carbon copy of Twelve South's 'Surface Pad' but with a few tweaks here and there.

Only thing with this is that in order to answer a call, you would have to not just open 1 flap but actually 2 flaps!!!!! That's too much time and probably have missed the call by the time you get there!

I compared Twelve South's and to be honest I'd not call it a clone, sure there is some resemblance but not a lot.

It isn't a copy at all. These type of cases were available way before the SurfacePad which isn't a case. I also suspect Element Case's iPhone 5 model will be a difficult case to handle with that overlapping flap design. It's not designed as well as it could have been. Reminds me of one of these:
