eyetv and kernel panics

I have been getting frequent kernel panics when using my eyetv usb wonder. I've looked at the panic log it has something to do with the apple io usb toolkit. Elgato claims there is a problem with the software and it is Apple's fault. Apparently it was supposed to be fixed with 10.4.4..

Anyone else experiencing this??
